Questions about the obligation to record working time digitally
Who is required to record working time digitally?
In its September 2022 ruling, the German Federal Labor Court (BAG) held that employers must record employees' working hours systematically. In a dispute with their employer, employees can now cite this top-court ruling. In its ruling, the BAG refers to a 2019 judgment of the European Court of Justice (ECJ) which obliges all member states of the European Union (EU) to pass a law requiring companies to introduce a system that records employees' working hours to the minute. The working time performed must be viewable by the employee at all times.
The aim of the obligation is to protect employees from excessive overtime and exploitation and to create better documentation of working time. Whether working time can also be recorded on paper or in Excel has not been clearly settled. Either way, companies that do nothing are taking a risk.
