Yes – with no exception. In 2019 the European Court of Justice ruled that all EU employers must record their employees' working hours systematically. In September 2022 the German Federal Labour Court set this out in concrete terms for Germany: the obligation follows from Section 3 of the German Occupational Safety Act and applies across all sectors. The German Federal Ministry of Labour has expressly clarified that there are no exceptions for teaching staff.
For independent schools the same applies as for any other employer: they can and must act now. At state schools the decision lies with the individual federal state – some states such as Bremen are already running pilot projects. Providers who wait are taking a legal risk.
