Working in shifts is the backbone of many industries. But when working hours do not just move around but switch regularly between day and night, we are talking about a particular challenge: rotating shift work. What exactly is rotating shift work?

With rotating shift work, working hours are spread across different shifts (usually early, late and night shifts), through which employees move in rotating shift groups following a set rhythm.

The legal framework: what the German Working Hours Act says 

Strict statutory rules apply to rotating shift work and the night work that goes with it. The German Working Hours Act (Arbeitszeitgesetz, ArbZG) even devotes its own section, Section 6, to these areas. 

If your employees work rotating shifts, you have to observe the following basic rules: 

  • Maximum working hours: The maximum working time per working day is 8 hours. An extension to up to 10 hours is only permitted if the extra hours are compensated for within 4 weeks. 
  • Occupational health checks: Employees have the right to an occupational health examination – every three years, in fact. For employees over 50, this right applies annually. The employer has to bear the costs for this. 
  • Duty to compensate: The employer is obliged to compensate for the strain of night and rotating shift work through an “appropriate number of paid days off” or through a pay premium. From a health point of view, comp time is usually the better choice for employees' recovery. 

Special case TVöD: how it is regulated in the public sector

Many collective agreements, such as the collective agreement for the German public sector (TVöD), set out even more precise requirements. Here a strict distinction is drawn between shift work and rotating shift work. 

Anyone who works permanent rotating shifts under the TVöD (that is, who is deployed around the clock 7 days a week on a regular rotation) receives a fixed monthly rotating shift allowance of €105.00. If an employee works rotating shifts only as cover, there is an allowance of €0.63 per hour. In addition, collectively agreed staff working permanently in rotating shifts receive one day of additional vacation for every two consecutive months.

Constant rotation throws the body clock thoroughly out of step. Possible consequences are sleep and concentration problems. The Working Hours Act therefore requires shift schedules to be designed according to established findings in occupational science. 

How to ease the load on your team in practice: The golden rule when drawing up shift schedules is forward rotation. That means the shift schedule rotates clockwise: an early shift is followed by the late shift, and that is then taken over by the night shift. Also avoid having employees work too many night shifts in a row (a maximum of 2 to 3 is recommended) and make sure there are at least 48 hours of genuine time off after a run of shifts, so the team can recover.

Depending on the industry – whether in a hospital, the fire service or industrial production – different shift models are used, from 2-shift to 5-shift systems.
